Busted In Acadiana

According to court records, Judge Marilyn Castle will hear the motion filed by the State for recusal of Judge Herman Clause next Wednesday at 1:30.

Yesterday Fontenot and his attorney appeared before Judge Clause in a preliminary hearing requesting a bond reduction on the two attempted first degree murder charges and that bond be set on the first degree murder charge of 15-year-old Austin Rivault.

Judge Clause advised a packed court room that he knew one of the surviving victim’s families and was also advised that Fontenot’s girlfriend attended the same church as him during bible study.

While Fontenot’s attorney had no problem with Judge Clause proceeding with the hearing, the state requested the long time judge to recuse himself from the case.

In the meantime, Seth Fontenot will remain behind bars until at least next week when Judge Castle renders a decision.
